ACCURA Dash – Terms of Service

(Effective as of 12.03.2025)

Welcome to ACCURA Dash, a SaaS solution provided by DTS Marketing Pte Ltd (“DTS,” “Company,” “we,” “us,” or “our”). By using ACCURA Dash, you (“User,” “you,” or “your”) agree to be bound by these Terms of Service (“Agreement”).

1. Acceptance of Terms

By clicking “I Agree”, accessing, or using ACCURA Dash, you acknowledge that you have read, understood, and accepted this Agreement in its entirety. Any new features or tools which are added to the current store shall also be subject to the Terms of Service. If you do not agree, you must discontinue access and refrain from using the Service.

2. Subscription & Payment Terms

2.1. Subscription Plans

2.1.1. ACCURA Dash operates on a subscription basis which offers multiple plans designed to accommodate your needs. Pricing, features, and billing frequency are detailed on our website.

2.1.2. ACCURA Dash provides a 7-day free trial.

2.2. Automatic Renewal

2.2.1. By registering for the trial, you acknowledge that unless you cancel before the trial period expires, your subscription will automatically renew under the chosen plan, and the corresponding charges will be applied.

2.2.2. You authorize automatic billing via your payment method on file.

2.3. No Refund Policy

2.3.1. All payments are final and non-refundable regardless of early termination or partial usage of the service.

2.3.2. Free Cancellation Before Billing: You have the option to cancel your subscription at any time before the trial period ends or before the next billing cycle to prevent any charges. If you cancel, your access will remain active until the end of your current billing period.

2.3.3. Cancellation Process: You can cancel your subscription via your account settings or by reaching out to our support team before the renewal date.

2.4 Failure to Pay

2.4.1. If a payment fails or remains outstanding, your access may be temporarily suspended until payment is successfully processed. DTS is not liable for any losses, disruption or damages resulting from service suspension due to unpaid balances.

3. Account & Usage Rules

3.1. User Responsibilities

3.1.1. You are solely responsible for maintaining the confidentiality and security of your login credentials.

3.1.2. You must not share, resell, misuse, or allow unauthorized access to your account.

3.1.3. Any actions taken under user’s account or password are the responsibility of user.

3.1.4. DTS reserves the right, at its sole discretion,  to deny service, suspend or terminate accounts engaging in fraudulent or abusive behavior.

3.2. Prohibited Activities - Users must NOT:

3.2.1. Copy, modify, or redistribute platform content, software, or branding without permission.

3.2.2. Selling or sublicensing platform features without authorization of DTS Marketing Pte. Ltd.

3.2.3. Use bots, scraping tools, or unauthorized automation.

3.2.4. Upload malicious software or attempt to breach security.

3.2.5. Create multiple accounts to avoid restrictions, overdue payments, or policy enforcement.

3.2.6. Provide false tenant information, lease details, or identity verification.

3.2.7. Post misleading reviews, feedback, or defamatory content about tenants, landlords, or property managers.

3.2.8. Exploiting free trials, promotions, or discounts by creating multiple accounts.

3.2.9. Failing to comply with subscription billing terms or misusing cancellation policies.

4. Data Privacy & Security

4.1. Data Ownership & Protection

4.1.1. Your ownership of data inputted or stored within the platform is subject to your subscription plan:

a. Premium & Enterprise Plans: users retain full ownership to their stored and/or downloaded data.

b. Basic & Standard Plans: ownership and access to stored data may be limited based on storage capacity, data retention policies, and export options.

c. Free & Trial Users: data ownership is restricted, and DTS reserves the right to limit access, retention, or deletion of data once the trial period expires.

 

4.1.2. Once data is exported or downloaded, DTS no longer has control or responsibility for its security, accuracy, or use, and users are fully liable for any misuse, data breaches, or legal violations arising from downloaded data.

4.1.3. DTS employs industry-standard security protocols to protect your data; however, we are not liable for data breaches resulting from third-party providers, cyberattacks, or user negligence.

4.1.4. Your data may be stored in Singapore or other regions to comply with legal, regulatory, or operational requirements.

4.2. Third-Party Integrations

4.2.1. Use of third-party services is entirely at your own risk.

4.2.2. ACCURA Dash may integrate with third-party applications for enhanced functionality. However, we do not control or assume responsibility for their data privacy, security, or compliance policies.

4.2.3. By using third-party services, you acknowledge that their use is at your own risk, and it is your responsibility to review and accept their terms.

5. Service Availability & Limitations

5.1. Uptime & Maintenance

5.1.1. We strive to maintain 99.5% uptime; however, uninterrupted access cannot be guaranteed due to unforeseen circumstances.

5.1.2. Scheduled maintenance and system updates may result in temporary downtime, which will be communicated in advance whenever possible.

5.1.3. In the event of unexpected outages, we will work diligently to restore services as quickly as possible.

5.2. Service Suspension

5.2.1. We reserve the right to suspend or restrict access to the platform without prior notice under the following circumstances if:

 

a. you breach this Agreement or fail to comply with our policies.

b. we detect fraud, abuse, unauthorized access, or any illegal activity associated with your account.

c. subscription payments fail or remain outstanding beyond the grace period.

 

5.2.2. Access may be reinstated upon rectification of the issue or at our discretion.

6. Intellectual Property

6.1. Ownership

6.1.1. ACCURA Dash, including all software, content, trademarks, logos, and related intellectual property, is the exclusive property of DTS.

6.1.2. Use of the platform does not grant users any ownership rights, licenses, or claims over ACCURA Dash or its proprietary assets.

6.2. Restrictions

6.2.1. You may not copy, resell, sublicense, or distribute ACCURA Dash or any of its components without prior written consent from DTS.

6.2.2. Any attempt to replicate, modify, reverse-engineer, or develop a competing platform based on ACCURA Dash’s proprietary technology, data, or insights is strictly prohibited.

7. Limitation of Liability

7.1. No Warranties

7.1.1. The service is provided "as is" and "as available", without any express or implied warranties.

7.1.2. We do not guarantee specific outcomes, uninterrupted availability, or that the software will be free from errors, bugs, or vulnerabilities.

7.1.3. Users acknowledge that occasional service disruptions, maintenance, or technical issues may occur.

7.2. Liability Cap

7.2.1. DTS’s total liability, if any, is capped at the total amount paid by the user in the last one (1) month of their subscription.

7.2.2. DTS is not liable for any indirect, incidental, or consequential damages, including but not limited to:

a. Loss of revenue, business opportunities, or data

b. Operational disruptions, downtime, or system failures

c. Third-party service failures or integration issues

8. Termination

8.1. User Termination

8.1.1. You may cancel your subscription at any time via your account settings.

8.1.2. Your access will remain active until the end of the current billing cycle, after which your account will be deactivated.

8.2. DTS Termination Rights

8.2.1. DTS reserves the right to immediately terminate or suspend your access if you violate these Terms, engage in fraudulent activity, or misuse the platform.

8.2.2. DTS may also discontinue ACCURA Dash at its sole discretion, with a minimum of 30 days' prior notice to users.

9. Governing Law & Dispute Resolution

9.1. Jurisdiction

9.1.1. This Agreement is governed by the laws of Singapore, without reference to its conflict of law principles.

9.2. Dispute Resolution

9.2.1. In case of disputes, both parties agree to first attempt mediation in good-faith.

9.2.2. If unresolved, disputes shall be settled by binding arbitration in Singapore.

10. Changes to Terms

10.1. DTS reserves the right to modify or update these Terms periodically.

10.2. Your continued use of the platform after any changes take effect constitutes your acceptance of the revised Terms.

10.3. We encourage users to review this agreement regularly to stay informed of any updates.

11. Indemnification

11.1. You agree to indemnify, defend, and hold harmless DTS Marketing Pte. Ltd., its officers, directors, employees, agents, subsidiaries, and affiliates from any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising from:

a. Your breach of this Agreement or non-compliance with platform policies.

b. Your violation of any laws, regulations, or third-party rights while using the system.

c. Disputes or claims related to your transactions, interactions, or activities with tenants, landlords, property managers, or service providers.

11.2. This indemnification applies to direct actions, omissions, and any unauthorized use of your account.

12. Liability Disclaimer & Platform Responsibilities

12.1. ACCURA Dash platform facilitates tenant-landlord interactions and property-related management. However, we do not control, verify, or take responsibility for user-generated content, agreements, or actions.

12.2. ACCURA Dash is not a real estate broker, agent, or property owner. The platform connects property managers, tenants, and landlords but is not directly involved in lease agreements, rental transactions, or disputes.

12.3. ACCURA Dash does not warrant the accuracy, legality, or completeness of listings, lease details, rental prices, or other user-generated content.

12.4. ACCURA Dash does not verify a tenant’s ability to pay, a landlord’s compliance with lease terms, or a property manager’s service commitments.

12.5. Users are solely responsible for their interactions, transactions, and compliance with applicable laws.
